Neutral Marketplace: MusicStockArt operates as a neutral online marketplace that facilitates licensing transactions between independent content creators ("Contributors") and content purchasers ("Buyers"). We provide technological infrastructure for these transactions but do not own, control, or author the content available on our platform.
Not a Publisher: MusicStockArt is not a publisher, record label, music library, or content owner. We do not create, curate, endorse, or guarantee the quality, accuracy, legality, or originality of any content uploaded by Contributors.
Third-Party Content: All content available for licensing is owned by independent Contributors who retain full copyright ownership. MusicStockArt makes no representations or warranties regarding the accuracy of contributor claims, the absence of third-party rights, or the suitability of content for any particular use.
No Verification: While we require Contributors to attest to ownership and rights, we do not independently verify these claims. Buyers are responsible for conducting their own due diligence regarding content rights.
Registration: You must create an account to purchase and download content. You are responsible for maintaining the confidentiality of your account credentials.
Accuracy: You agree to provide accurate, current, and complete information during registration.
Account Security: You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
Credits: Content can be purchased using credits. Credits are non-refundable and non-transferable.
Pricing: All prices are subject to change without notice. The price at the time of purchase applies.
Payment Processing: Payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service.
Refunds: Due to the digital nature of our products, all sales are final. Refunds may be issued at our sole discretion for technical issues or duplicate purchases. See our complete Refund Policy for details.
License Types: We offer Editorial, Standard, Enhanced, and Extended licenses. Each license grants specific usage rights as detailed on our License Agreement page.
License Grant: Upon purchase, you receive a non-exclusive, worldwide license to use the content according to the selected license type.

Compliance: You agree to use content only within the scope of your purchased license. Unauthorized use may result in legal action and liability for damages.
Content Submission: Contributors grant MusicStockArt a non-exclusive, worldwide license to distribute their content through our marketplace.
Revenue Share: Contributors receive 50-60% of net revenue from content sales, paid monthly when earnings exceed $50.
Ownership Warranty: Contributors warrant and represent that they:
AI Content Disclosure: Contributors must disclose if content was created using AI tools. Failure to disclose may result in content removal and account termination.
Indemnification: Contributors agree to fully indemnify and hold harmless MusicStockArt, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from or related to: (a) the content they submit; (b) any breach of their representations or warranties; (c) any claim that their content infringes third-party rights.
Content Removal: MusicStockArt reserves the right to remove any content at any time, for any reason, without prior notice or liability.
Copyright: All content on MusicStockArt is protected by copyright law. Contributors retain copyright to their work.
Trademarks: MusicStockArt and its logo are trademarks. Unauthorized use is prohibited.
DMCA: We respect intellectual property rights. To report copyright infringement, contact us at legal@musicstock.art with details of the alleged infringement.
Usage Monitoring: We reserve the right to monitor how licensed content is used.
Enforcement: License violations may result in:
Audit Rights: We reserve the right to audit usage of content by commercial users.

As-Is Basis: The Service is provided "as is" without warranties of any kind, express or implied.
No Guarantee: We do not guarantee that content is error-free, that defects will be corrected, or that the Service will be uninterrupted.
Third-Party Content: We are not responsible for the accuracy, legality, or quality of contributor content.
To the maximum extent permitted by law, MusicStockArt shall not be liable for:
Our total liability shall not exceed the amount you paid in the 12 months prior to the event giving rise to liability.
You agree to indemnify and hold harmless MusicStockArt from any claims, damages, losses, or expenses (including legal fees) arising from:
By You: You may close your account at any time. Credits are forfeited upon account closure.
By Us: We may suspend or terminate your account for violation of these Terms, illegal activity, or at our discretion.
Effect: Upon termination, your license to use the Service ends. Previously purchased licenses remain valid unless revoked for violation.
These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.
Any disputes shall be resolved in the courts of California.
We may modify these Terms at any time. Changes become effective upon posting. Continued use of the Service constitutes acceptance of modified Terms.
